Expose implementation status

The state of the implementation of the most important tasks included in Prime Minister Donald Tusk’s expose as of 27 January 2012.


PUBLIC FINANCE
Draft of the law on the amendment of the law on public finance and other laws (planned adoption by the government – first quarter of 2012, inter-ministerial coordination is under way as well as consultations with the self-government side). The proposed solutions will facilitate to limit the growth of debt and deficit of local self-government entities and will create conditions for introducing a fiscal rule for the entire public finance sector.

PENSION SYSTEM
Draft of the law on the amendment of the law on old age and disability pensions and some other laws (planned adoption by the government – first quarter of 2012, work on the draft is under way). The regulation concerns the reform of the pension system and contains solutions ensuring both the system’s safety (demographic changes) and the safety of the public finance system (limitation of the growth of public debt). As of 2013, the retirement age for men and women will be equalised and increased gradually – eventually we shall work until the age of 67.

Draft of the law on the amendment of the law on old age and disability pensions from the Social Insurance Fund and some other laws (the president signed the law and sent it to the Constitutional Tribunal, valorisation of old age and disability pensions will take place on 1 March 2012). The introduction of the new principles of valorising old age and disability pensions will help reduce differences in their amounts. The valorisation will be advantageous for the less affluent old age and disability pensioners.

The draft of the pension law for uniformed services (planned adoption by the government – first quarter of 2012, inter-ministerial coordination is under way). In keeping with the intention of the government, the new model of pension protection for uniformed services envisages the lengthening of the labour period indispensable for acquiring pension rights and definition of the age authorising to collect pension.

TAXATION SYSTEM
The law on the amendment of certain laws connected with the implementation of the budgetary law (solutions sealing the collection of the so-called Belka’s tax will become effective as of April 2012). The budget-related law contains solutions, which make it impossible to bypass the tax on capital revenues in case of bank deposits. The point is the so-called daily deposits in case of Belka’s tax.

The draft of the law on the amendment of the law on the income tax on physical persons (planned adoption by the government – first quarter of 2012, the draft is under preparation). Envisaged is: - reduction of the Internet allowance; - changes in the application of a 50 per cent deduction of the cost of acquiring revenues (the reduction will be possible in case of annual revenues amounting to PLN 85 thousand); - changes in the allowances for children in order to support families in the lowest income brackets and having three or more children: a) for families rearing one child, whose annual income does not exceed PLN 85 thousand, the allowance remains unchanged; b) families rearing one child, whose annual income exceeds PLN 85 thousand, will not be entitled to the allowance; c) in case of families reading two children – regardless of the acquired revenues – the allowance will remain unchanged; d) in a family with three children or more - regardless of the acquired revenues – all the children will be entitled to the allowance but in case of the third and every next child it will be raised by 50 per cent.

The draft of the law on the amendment of the law on money considerations (planned adoption by the government – first quarter of 2012, inter-ministerial coordination is under way). The proposed changes serve the implementation of the justice and social solidarity principle. Limited will be the number of persons authorised to receive a one-time childbirth benefit. This benefit will be available for families with the annual income not exceeding PLN 85 thousand.

Provisions to the draft law on the amendment of the law on the income tax on physical persons, the law on the income tax on legal persons, the law on the lump-sum income tax on some revenues acquired by physical persons, the law on the agricultural tax (planned adoption by the government – first quarter of 2012, the draft is under preparation). It is envisaged to cover with the income tax revenues acquired from agricultural activity. The planned solutions cover; modification of the agricultural tax stemming from the introduction of the income tax; abolishment of the price of rye as the foundation for fixing the agricultural tax rate and introduction of a rate valorised each year by the inflation index; limitation of exemptions and allowances in connection with covering revenues from agricultural activity with the income tax.

INSURANCE ALLOWANCES
The law on the amendment of the law on the social insurance system (effective as of 2 February 2012). Disability premium on the employer’s side will be raised by two percentage points. This solution will improve the situation of the public finance sector limiting the growth of public debt.

The law on 2012 health insurance premiums for farmers not engaged in the activity covering special agricultural production fields and their housemates and on the amendment of the law on health protection services financed from public resources (effective as of 1 February 2012). In keeping with the ruling of the Constitutional Tribunal, a health care premium for farmers will be introduced. The principles of paying it are as follows: for farmers possessing less than 6 ha, the premium will be covered by the state budget; - farmers having farms from 6 to 15 ha will pay the premium in the amount of PLN 18; - farmers having farms larger than 15 ha will pay the premium in the amount of PLN 36.

NATURAL RESOURCES
Draft of the law on the tax on extraction of some minerals (work in the Sejm is under way). According to the Prime Minister’s announcements, the new regulations will guarantee the state to participate in profits stemming from the exploitation of some state-owned natural resources (tax on copper and silver).

Provisions to the draft law on the tax on hydrocarbon extraction (planned adoption by the government – first quarter of 2012, the draft is under preparation). The new regulations will guarantee the state adequate share in the raw material pension. This concerns profits stemming from shale gas extraction.

ENTREPRENEURSHIP
Provisions to the draft law on the reduction of some administrative burdens in the economy (planned adoption by the government – second quarter of 2012, the draft is under preparation). The proposed solutions are a continuation of actions aimed at limiting administrative burdens and information tasks concerning the running of economic activity and at cutting down the cost of performing such activity borne by the entrepreneurs.

Provisions to the draft of the new Building Law (envisaged date of sending the draft for inter-ministerial consultations – second quarter of 2012). The document will take into account solutions that will facilitate the course of the building process. The new regulations will define the general principles of the construction of edifices, will introduce investor-friendly procedure of locating building objects, and simplify the administrative procedures before the start of construction work.

JUDICIARY
Provisions to the draft law on the amendment of the Code of Penal Proceedings, Code of Offence Proceedings and the Code of Revenue Proceedings (planned adoption by the government – second quarter of 2012, the draft is under preparation). The changes are connected with the Prime Minister’s announced acceleration of court proceedings by one-third. The admission of court referendaries to execute proceedings (on penal, penal revenue and offence cases) should shorten and streamline the proceedings.

Provisions to the draft law on the amendment of the Code of Penal Proceedings and some other laws (planned adoption by the government – first quarter of 2012, the draft is under preparation). The changes are to cut down the time of penal proceedings by one-third. Concerns: the right of the accused to take part in the trial (obligatory until now); admission of court referendaries to execute actions in penal proceedings; limitation of the possibility of returning the case to the prosecutor’s office; introduction of a new kind of property safeguard (protection of financial resources on the pay card).

Provisions to the draft law on the amendment of the Law on the structure of general courts and the Law on the prosecutor’s office (planned adoption by the government – first quarter of 2012, the draft is under preparation). The document is connected with the Prime Minister’s announced review of the authorisations of inactive prosecutors and judges. The changes will concern the age of becoming inactive and the period of service authorising to become inactive.

REMAINING
Provisions to the draft law on repealing or changing the laws regulating the execution of certain professions (planned adoption by the government – second quarter of 2012, the draft is under preparation). It is proposed to open up the access to the so-called regulated professions (requiring defined qualifications envisaged in legal regulations).

Draft law on the amendment of the law on the Bank Guarantee Fund (BGF) and some other laws (planned adoption by the government – first quarter of 2012, inter-ministerial consultations are under way). Proposed will be the introduction to the Polish legal system of the so-called circumspection fee in order to acquire additional, non-budgetary means for financing the activities aimed at maintaining the stability of the banking sector. This means that some financial institutions will be obliged to pay the circumspection fee to the Bank Guarantee Fund. These resources will be recorded on the special Stabilisation Fund. The fee would be paid twice a year and its amount will be determined annually by the BGF Council.

The block of draft laws concerning e-administration: provisions to the draft law on the amendment of the law on the digitalisation of the activity of entities implementing public tasks, provisions to the draft law on the opening of public resources, provisions to the draft law on the amendment of some laws in connection with the changes in the organisation of local state administration organs (planned adoption by the government – first quarter of 2012, the drafts are under preparation). The drafts of legal acts prepared in the Ministry of Administration and Digitalisation will implement the idea announced by Prime Minister Tusk of streamlining the work of the administration using the most up-to-date information technology contributing to the more general use by the citizens of various types of resources including the educational, cultural and scientific ones.

Provisions to the draft law on the amendment of the law on the National Court Register (NCR) and other laws (planned adoption by the government – first quarter of 2012, the draft is under preparation). The changes are to streamline the procedure of registration of entrepreneurs in the NCR. Envisaged is a limitation of formal requirements connected with taking up economic activity and resignation from the requirement of filling in a number of forms and certificates including the automatic conferring of NIP and REGON numbers after the entry to the register.

Provisions to the draft law on the amendment of the law Code of proceeding offence cases (planned adoption by the government – second quarter of 2012, the draft is under preparation). The introduction of electronic protocol from the trial of offence cases (in the form of electronic sound recording).

Provisions to the draft law on the amendment of the Bankruptcy and redress law (initial work concerning the direction of changes is under way). The point is to facilitate a greater number of consumers to take advantage of consumer bankruptcy. The currently binding regulations were too rigorist. Premises for declaring consumer bankruptcy will be extended.

Provisions to the draft law on the amendment of the law on the land and mortgage register (it is envisaged that in the first quarter of 2012, the draft will be submitted for review by the permanent Committee of the Council of Ministers). Envisaged are facilitations for citizens through statutory guarantees of common, free access to study the land and mortgage register through the Internet and obtaining electronic copies from it.

Proposal of the reform of the principles of entitlement to old age pensions (the draft is under preparation). This concerns pensions of miners. Only face foremen will be entitled to benefit from the privilege.

Issuance of decrees facilitating payment for soldiers and police officers PLN 300 pay rise as of 1 July 2012 (the drafts are under preparation).
